Who we are
1. This website is operated by Qatar Pay Payment System. (“QATAR PAY””, “we”or “us”). Qatar Pay is Electronic wallet that offers the most convenient way to pay by allowing to simply use phone to pay instead of cash or plastic credit cards, and providing a cashless and card less ePayment acceptance within Qatar.
2. Our privacy policy and terms of use (respectively referred to from now on as the “Privacy Policy”and the “Terms of Use”) apply when you use our website (com) (“our Site”) our mobile Application or any service of our platform through direct or non-direct integration. Please read the Privacy Policy and Terms of Use carefully before you start to use our services. By using our services, you indicate that you accept the Privacy Policy and Terms of Use and that you agree to abide by them. If you do not agree to them, please refrain from using our service.
Defined terms used in terms of use
1. “Software”means any software accessible on our Site for the use of Users (whether free or if payment is required).
2. “User”means any person using our Site/App or the Software (whether that person has paid for such use or not) and “Users”, “you” and “your” shall be construed accordingly.
3. “Authorized Users”means those employees, agents and independent contractors connected to you who are authorized by you to use the Services and the Documentation.
Access to our site / App
1. Access to our Site / App and to our Services is permitted on a temporary basis, and we reserve the right to withdraw or amend the content of our Site and any Software available on it without notice. From time to time, we may restrict access to some parts of our App, or our entire Site. We will not be liable if for any reason our Site or our Services are unavailable at any time or for any period.
Use of the Services
1. As a condition of your (“you”or “your”) use of the Site and the Services, you agree that:

  2. You are using the Services on behalf of a company or other legal entity.
  3. You have the authority to bind your company or other legal entity and its affiliates to the Terms of Service.
  4. You are using the Services as a private individual or consumer.
  5. You are not barred from using our Services under applicable law.
  6. You will not attempt to use the Services with crawlers, robots, data mining or extraction tools or any other functionality.
  7. Your use of the Site and the Services will at all times comply with these Terms of Service.
  8. You will only engage in transactions that comply with the letter and spirit of these Terms of Service.
  9. You have the right to provide any and all information you submit through the Site and Services, and the information and all such information is accurate, true, current and complete.
  10. You will update and correct information you have submitted through the Site/App and Services and ensure that it is accurate at all times (out-of-date information will invalidate your account).
2. Subject to your compliance with the terms and conditions contained in the Terms of Service, we hereby grant to you a non-exclusive, non-transferable right to use the Services solely for your internal business operations.
3. You shall not, and shall not permit Authorized Users, to access, store, distribute or transmit any Viruses, or any material during the course of your use of the Services that:
  1. Are unlawful, harmful, threatening, defamatory, obscene, infringing, harassing or racially or ethnically offensive.
  2. Facilitate illegal activity.
  3. Upload sexually explicit images or videos.
  4. Promote unlawful violence.
  5. Are discriminatory based on race, gender, color, religious belief, sexual orientation, disability, or any other illegal activity. or
  6. Cause damage or injury to any person or property.
4. You shall not, and shall not permit the Authorized Users to:
  1. except as may be allowed by any applicable law which is incapable of exclusion by agreement between the parties:
    1. Attempt to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any portion of the Software in any form or media or by any means.
    2. Attempt to reverse compile, disassemble, reverse engineer or otherwise reduce to human-perceivable form all or any part of the Software.
  2. Access all or any part of the Services in order to build a product or service which competes with the Services.
  3. Use the Services to provide services to third parties, except where explicitly indicated on the Site.
  4. License, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit, or otherwise make the Services available to any third party except you or the Authorized Users.
  5. Attempt to obtain, or assist third parties in obtaining, access to the Services and/or Documentation, other than as provided under this Clause B.
5. You shall use all reasonable efforts to prevent any unauthorized access to, or use of, the Services and, in the event of any such unauthorized access or use, promptly notify us.
6. We reserve the right, without liability to you, to disable, suspend or terminate your access to the Services, the Site, your account or any material if you breach any provision of the Terms of Service.
Prohibited Uses
1. You may use our Site/App only for lawful purposes. Including, but not limited to the following, you may not use our Site:
  1. in any way that breaches any applicable local, national or international law or regulation.
  2. in any way which contravenes the virus and hacking provisions as set out in Clause 9 (Viruses, Hacking and Other Offences).
  3. to upload, post, email or otherwise transmit any content that is directed to inciting or producing imminent conduct that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable and is likely to produce such conduct.
  4. to impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity.
  5. to forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the system.
  6. to upload, post, email or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
  7. to upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” or “pyramid schemes”.
  8. to interfere with or disrupt our Site’s system or servers or networks connected to our Site’s system, or disobey any requirements, procedures, policies or regulations of networks connected to our Site’s system.
  9. to collect or store personal data about other Users without their knowledge.
2. Intellectual property rights
  1. We are the owner or the licensee of all intellectual property rights on our Site/App and nothing in these Terms of Use shall grant you any rights, title or interest in and to such intellectual property rights. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
  2. You must not use any part of the materials on our Site/App or the Software for commercial purposes.
  3. If you print off, copy or download any part of our Site or of the Software in breach of these Terms of Use, your right to use our Site and the Services will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
3. Reliance on information posted
  1. We are not responsible for the data and information provided by the service users (suppliers, partners, merchants, and buyers ) (for example product details) and other materials posted, or on our Site/App and we disclaim all liability and responsibility arising from any reliance placed on such materials by any User or visitor to our Site.
4. Information about you and your visits to our site/App
  1. We process information about you in accordance with our Privacy Policy. By using our Site, you consent to such processing and you warrant that all data provided by you is accurate.
5. Viruses, hacking and other offences
  1. You must not misuse our Site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful.
  2. You must not attempt to gain unauthorized access to, interfere with, damage or disrupt our Site/App, the server, equipment or network on which our Site/App is stored, any software used in the provision of our Site or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack.
  3. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or due to you downloading any Software or material posted on it, or on any website linked to it.
  4. You must not reproduce duplicate, copy or re-sell any part of our Site or our Software in contravention of the provisions of these Terms of Use.
6. Suspension and termination
  1. We will determine, in our discretion, whether there has been a breach of these Terms of Use through your use of our Site/App or the Services. Failure to comply with these Terms of Use constitutes a material breach of the Terms of Use upon which you are permitted to use our Site/App and our Services, and may result in our taking all or any of the following actions:
    1. Immediate, temporary or permanent withdrawal of your right to use our Site/App and/or our Software with no refund.
    2. Immediate, temporary or permanent removal of any posting or material uploaded by you to our Site/App.
    3. Issue of a warning to you.
    4. Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
    5. Further legal action against you.
    6. Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
  2. The responses described in these Terms of Use are not limited, and we may take any other action we reasonably deem appropriate.
7. Our liability
  1. The material displayed on our Site/App and on any Software is provided without any guarantees, conditions or warranties as to its accuracy, quality or suitability for any particular purpose. All information contained on our Site has been compiled and obtained from sources believed to be reliable and credible but all such information, and the Software, is provided ‘as is’ without warranty of any kind. We hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by law, and make no representation or warranty, express or implied, as to the accuracy or completeness or satisfactory quality or fitness for a particular purpose of the information on our Site/App or the Software. To the extent permitted by law, and subject to Clause 11.2, we hereby expressly exclude liability for:
    1. All conditions, warranties and other terms which might otherwise be implied by law.
    2. Any direct, indirect or consequential loss or damage incurred by you or any User in connection with our Site/App and/or the Software, or in connection with the use, inability to use, or results of the use of our Site, any websites linked to it and any materials posted on it, including, without limitation any liability for loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted management or office time, or for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if reasonably foreseeable, provided that this condition shall not prevent claims for loss of, or damage to, your tangible property.
  2. The provisions of this Clause 10 do not limit or exclude our liability for fraud or fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
8. Limitation of Liability
  1. IN NO EVENT SHALL QATAR PAY, ITS SUBSIDIARIES OR AFFILIATES OR ANY OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, MERCHANTS, PARTNERS, THIRD-PARTY CONTENT PROVIDERS OR LICENSORS, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO: (A) YOUR USE OF THE SITE/APP OR SERVICES. (B) YOUR INABILITY TO USE THE SITE/APP OR SERVICES. (C) MODIFICATION OR REMOVAL OF CONTENT SUBMITTED THROUGH THE SERVICES.
9. Force Majeure
  1. QATAR PAY shall be excused from performance under these Terms of Service to the extent it is prevented or delayed from performing, in whole or in part, as a result of an event or series of events caused by or resulting from: (a) weather conditions or other elements, (b) acts of war, acts of terrorism, (c) quarantines or embargoes, (d) error or disruption to major computer hardware or networks or software failures. or (e) other causes beyond the reasonable control of QATAR PAY.
10. Links from our site/App
  1. Where our Site contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility or liability for them or for any loss or damage that may arise from your use of them.
11. Our right to vary these terms of use and privacy policy
  1. We may revise these Terms of Use or the Privacy Policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on our Site.
12. Applicable law
  1. These Terms of Use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Qatar.
13. Entire agreement
  1. These Terms of Use and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any contract.
  2. Each of us agrees that our only liability in respect of those representations and warranties that are set out in these Terms of Use (whether made innocently or negligently) will be for breach of contract.
